1. Agreement to these terms

These Terms of Use ("Terms") form a binding agreement between you and New York Auto Rental ("we", "us", "our") governing your use of newyorkautorental.com (the "Site"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. What the service is

New York Auto Rental is an independent comparison and referral service. We display car-rental options aggregated from third-party suppliers through our booking partners and link you to those partners to complete a reservation. We are not a car rental company, broker, or travel agent; we do not own vehicles, set prices, take payment, or enter into rental agreements with you. Any rental contract is solely between you and the rental supplier (with the booking partner acting as the booking agent).

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. Rental suppliers impose their own age, license, and payment requirements, which may be higher. By using the Site you represent that you meet these requirements.

4. Affiliate relationships

We participate in affiliate programs and may earn a commission when you book through our links, at no additional cost to you. This does not change the price you pay or the results we show. Full details are in our Affiliate Disclosure.

5. Pricing, availability & accuracy

All prices, vehicle details, fees, inclusions and availability are provided by third-party suppliers and partners and can change at any time without notice. We strive to present accurate information but do not guarantee that any price, description, or availability shown on the Site is current, complete, or error-free. The binding price and terms are those confirmed on the partner's site at the moment you book.

6. Bookings & your relationship with suppliers

When you proceed to book, you leave our Site and transact with a booking partner and rental supplier under their terms and privacy policies. They are responsible for the reservation, payment processing, the vehicle, insurance/coverage, deposits, cancellations, refunds, and customer support. Any dispute about a booking must be directed to the partner or supplier that holds your reservation. We are not a party to, and accept no responsibility for, that transaction.

7. Acceptable use

You agree not to:

• use the Site for any unlawful, fraudulent, or harmful purpose;
• scrape, harvest, or systematically extract data, or place undue load on the Site;
• interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems;
• frame, mirror, or misrepresent the Site, or remove any notices;
• introduce malware or use automated means to abuse our affiliate links.

8. Intellectual property

The Site, including its text, design, layout, graphics, and code, is owned by New York Auto Rental or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Site for your own non-commercial trip planning. All trademarks and brand names of suppliers and partners are the property of their respective owners and are used for identification only.

9. Third-party sites & content

The Site links to third-party websites and displays content sourced from third parties. We do not control and are not responsible for the content, products, services, policies, or practices of any third party. Links do not imply endorsement. Your use of third-party sites is at your own risk and subject to their terms.

10. Disclaimer of warranties

THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any deal shown will remain available or correctly priced.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW YORK AUTO RENTAL AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR TRAVEL ARRANGEMENTS, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY BOOKING MADE WITH A THIRD PARTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total aggregate liability for any claim relating to the Site will not exceed USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless New York Auto Rental and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms or any applicable law.

13. Changes to the service & terms

We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

14. Governing law & disputes

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at hello@newyorkautorental.com so we can try to resolve the matter informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to venue there, except where prohibited by applicable law.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger or sale. These Terms, together with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us regarding the Site. We are not liable for delays or failures caused by events beyond our reasonable control.
